If you believe the Town is responsible for any personal injuries or property damage, you must file a claim form (PDF) with the Town. Generally, this form must be filed with the Town within six months of the alleged incident.

The City Attorney can discuss legal issues pertaining to Town ordinances, Town Council or Planning Commission agenda items or other Town-related questions. However, the City Attorney is not permitted to give legal advice to private citizens on personal matters. The following is a partial list of resources for residents with legal questions:

- The Contra Costa County Superior Court provides a small claims advisor for individuals considering filing a small claims lawsuit.

A code violation is a condition tending to:
- Reduce the value of private property
- Promote blight and deterioration
- Constitute an attractive nuisance
- Injurious to the health, safety and general welfare
To respond to these conditions, the Town has adopted various codes and ordinances that help to ensure a clean and safe environment. Any non-compliance with the Town of Danville Municipal Code is considered to be a code violation. Some suspected violations are actually permitted activities.

There are some conditions or neighborhood issues that are not considered violations of the Danville Municipal Code. These conditions or neighborhood issues do not fall under Code Enforcement for enforcement. Code Enforcement does not enforce issues between residents that are civil in nature and does not enforce Covenants, Codes and Restrictions (CC&Rs). CC&Rs are a private agreement between property owners and are commonly enforced by the residential Homeowners' Association (HOA) or property management company.
The Town recommends that neighbors try to communicate with each other to work out their disputes. Neighbor Law, by Cora Jordan, is a resource that can help when researching tips and advice on how to resolve and restore good neighborhood relations. If the matter cannot be resolved through communication, the parties may choose to use the services of mediation or a civil court process.

Citations begin at $100 and may increase to $500 per day that the violation persists. Most violations are resolved prior to the imposition of a citation.

The allowable hours to operate or perform construction or repair work (which creates noise) within or adjacent to a residential land use district are Monday through Friday from 7:30 a.m. to 7 p.m. and Saturdays, Sundays and holidays from 9 a.m. to 7 p.m.

Code Enforcement can work with the property owner to clean up parts of their property. Code Enforcement works with property owners and tenants to remove or screen from public view inoperable vehicles, recreational vehicles, and junk on their property. The Town does not enforce the general maintenance of front yards such as tall weeds and dead lawns. If you live in an area with a Homeowners' Association (HOA), you may contact the HOA to see if they have more stringent regulations than the Town.
Parking Enforcement enforces inoperable vehicles and recreational vehicles illegally parked on the public right-of-way.

The Town does not have the authority to require a property owner to trim or remove any of their vegetation unless it encroaches into a public right-of-way that impedes either pedestrian or vehicular traffic.

The Town's Municipal Code does not address barking dogs. The Contra Costa County Animal Services (CCCAS) would be the appropriate department to contact in regards to this matter. The Town has a designated dog park (Canine Corral) that is located at Hap Magee Ranch Park, which allows dogs to be off leash. The Canine Corral is non-monitored and relies on its users to maintain reasonable conditions and sanitation. Before embarking on a trip to the Canine Corral it is important that users understand the rules and regulations to ensure an enjoyable experience for everyone.
As for the other parks, the Contra Costa County Animal Services (CCCAS) is responsible for enforcing leash laws. For more information, please contact CCCAS at 925-335-8300 or visit their website.

Select “Permit” from the dropdown menu, and search by address. If no results appear when searching by Address, try entering only a portion of the entire address. If there is a permit in “Issued” status, it means that the Town has authorized the construction described in the project description.

Plastic bags can only be recycled through the State's "In-Store" Recycling Program, where approximately 5% to 10% of bags are recycled. Unfortunately, recycling equipment cannot take plastic bags and in fact become jammed in conventional recycling equipment.

Plastic bags that end up in the garbage are transported to a nearby landfill. Plastic bags that stay in place will take at least 500 years to photo degrade, especially if they are buried deep beneath debris. Unfortunately many of the bags that are dumped in the landfill blow away and are caught in the fencing surrounding landfills such as Keller Canyon in Pittsburg. The cost to remove these bags is incurred by trash and recycling ratepayers.

In an effort to promote the use of reusable bags in Danville retail establishments, the Town is distributing 10,000 reusable shopping bags free of charge to local residents. These bags will be distributed through the Danville Farmers' Market on Saturdays and other special events. The reusable bags are part of an economic development effort and feature the Shop Danville brand, reminding residents to shop locally.

Violation of the ordinance is an infraction that would first involve a warning notice for the first violation, $100 for the 2nd violation, $200 for the 3rd violation and $500 for the 4th and subsequent violations.

Once the ordinance takes effect, if complaints are received about a business, courtesy notices would be sent to the merchant before any fines were issued. Given the Town's limited staffing resources on code enforcement (only half of a full-time staff person), other higher-priority quality-of-life issues would be addressed before efforts are spent enforcing the single-use plastic bag ordinance. No additional staffing resources would be spent on enforcement.

The Danville Police Department issues a 3-day temporary parking permit which will allow the RV owner time to load and / or unload their motor home or trailer. The permit must be displayed in the front left corner of the windshield.

- All of the applicants information is submitted by Records to the CCC Sheriff's VICE Unit where a background check will be performed. The check will include a Tax collector check and DOJ check. The fee for the Tax check is $60. The background check takes 30 to 60 days to complete.
- Applicant must submit to fingerprints check (live scan) and provide proof of a Bond to County records. This fee is $57 more or less.
- The County requires that the solicitor obtain a Business License through the Town of Danville if they are soliciting in Danville. To obtain a business license 925-314-3326
- Once the solicitor has filled out the County application and obtained a Business License they turn in their completed application to County Records.
- Once the solicitor has passed the background they will have the option to purchase a 3 month ($15) or 1 year ($60) permit. They will be issued a pocket ID card that they must carry with them when they are soliciting. The front of the card contains their photo and the following information: height, weight, hair color, eye color, vendor permit number. The back of the card contains the solicitors name, address and date of expiration.
- The solicitor must first obtain a permit application packet from Contra Costa County Records by calling 925-335-1570. This fee is $5.

The Town of Danville Police Department will accept expired or unused medications, however, we do not accept controlled (i.e. morphine, oxycodone, etc.) medication. The individual will dump all of the pills into one zip lock bag and recycle the bottles at home. Any medication that is not in pill form leave in its original container, scratch off the patient's name and prescription number and place the container(s) in a second, separate zip lock bag. Place the plastic bags in the green receptacle located in the Police Department lobby.

A hate crime is a crime against a person, group, or property motivated by the victim's real or perceived protected social group. You may be the victim of a hate crime if you have been targeted because of your actual or perceived: (1) disability, (2) gender, (3) nationality, (4) race or ethnicity, (5) religion, (6) sexual orientation, and (7) association with a person or group with one or more of these actual or perceived characteristics. Hate crimes are serious crimes that may result in imprisonment or jail time.
A hate incident is an action or behavior motivated by hate but which, for one or more reasons, is not a crime. Examples of hate incidents include:
- Name-calling
- Insults
- Displaying hate material on your own property.
- Posting hate material that does not result in property damage.
- Distribution of materials with hate messages in public places.
The U.S. Constitution allows hate speech as long as it does not interfere with the civil rights of others. While these acts are certainly hurtful, they do not rise to the level of criminal violations and thus may not be prosecuted. However, it is important to note that these incidents have a traumatic impact on the victims as well as on the community at large.

When registration falls below the minimum enrollment required, canceled with a makeup class, or illness, it may be necessary to cancel a class or program. At the time of cancellation, the Town will initiate a full refund, minus any credit card or service fees. Check refunds may take 4 to 6 weeks to process.
- Whenever possible, make-ups will be given on those occasions when inclement weather or instructor illness requires that a class be canceled. See instructor at next scheduled meeting for the make-up date.
- No refunds (whole or partial) can be given for classes missed by the student.

Yes. The photo liability disclosure includes understanding that photographs and/or video may be taken during the course of any activity and that these photographs and video may be used for Town of Danville publicity purposes.

Refund Policy
Unless otherwise stated, requested withdrawals will be approved upon submitting this request at least seven business days prior to the first day of class. Withdrawals requested within the seven business days of the date of the activity are not guaranteed refunds or credits. They will be processed and evaluated on a case by case basis.
A $20.00 administrative fee will be charged for processing refunds by check only.
A $5.00 per activity administrative fee will be assessed when processing refunds back to credit cards.
Credit Card Processing Fees are NON-REFUNDABLE.

Credit granted will first be applied to future or past payments due. Please tell us how you would like us to process any remaining credit for the withdrawal / transfer.Submitting the form authorizes the Town of Danville Recreation, Arts and Community Services to process the withdrawal. If the money was paid by check, it will be issued to the address on file within 4 to 6 weeks. If a credit card was the original form of payment, the same card will be credited.

Each quarter, the Town receives a number of questions regarding the residency status for individuals and families wishing to register for Town-sponsored programs and activities. Those living outside the Danville Town limits include residents of the communities of Alamo and Diablo, and the Alamo Creek, Bettencourt Ranch, Blackhawk, Bryan Ranch, Monterosso, Shadow Creek, and Whitegate housing developments. In order to verify your residency in Danville, you can:

- Review the information on your property tax bill
- Check your residency status online

The program and facility fees cover a large portion of the actual costs, though Town of Danville residents also partially support the classes, events, and facilities through their property tax assessments. Because of this, those program participants and individuals reserving Town facilities who live outside of Danville pay an additional non-resident charge.
Special Notice to Alamo Residents living in the Alamo County Service Area R-7A:
All Alamo residents are eligible to register for Town-sponsored programs scheduled at Hap Magee Ranch Park during the resident registration period. Effective May 9, 2023, resident fees will apply for these classes and activities. For more information, please call 925-314-3400.

Town of Danville instructors are independent contractors. An independent contractor creates their own curriculum, provides their own supplies and staffing. In addition, they set their own hours and budget and are entirely responsible for submitting an invoice to receive payment.

Every landlord shall deliver the following on or before May 1, 2016 to each unit of a multiple - family building.
- A copy of Ordinance No. 2015-04. Every landlord shall provide prospective tenants with a written notice clearly stating that:
- Smoking is prohibiting in all common areas, except for specifically designated smoking areas, as of May 1, 2016.
- Smoking is prohibiting in units, including any associated exclusive-use area or unenclosed area, as of May 1, 2016.
- A written notice to residents clearly stating that all units are designated nonsmoking units and smoking will be illegal in a unit, including 25 feet from any associated exclusive-use enclosed area or unenclosed area, such as a private balcony, porch, deck or patio, as of May 1, 2016.
- A copy of Ordinance No. 2015-04. Every landlord shall provide prospective tenants with a written notice clearly stating that:

New Resident Information - Smoking Ordinance
Clear and unambiguous "No Smoking" signs shall be posted in sufficient numbers and locations in common areas where smoking is prohibited. The signs shall be maintained by the person or persons with legal control over the common areas. "No Smoking" signs are not required inside doors or doorways of units. This applies to all multi-family housing, including apartments and condominiums.

Every lease or rental agreement entered into, renewed, or continued month-to-month after May 1, 2016 shall include the following provisions:
- A clause expressly conveying third-party beneficiary status to all occupants of the Multiple Family Building as to the smoking provisions of the lease or other rental agreement, granted those occupants the legal right to enforce the provisions of this lease.
- A clause providing that as of May 1, 2016, it is a material breach of the agreement for the tenant to engage in or allow smoking in the unit including exclusive use areas such balconies, porches, patios or in any common area of the property other than a designated smoking area.

A tenant or guest of a tenant will be liable to both the landlord and any occupant of the building who is exposed to smoke or suffers damages. The violation would be considered an infraction, with penalties ranging from $100 to $500. Each HOA or property manager may issue its own penalties, which may be financial and include eviction.

Eliminating smoking in indoor spaces is the only way to fully protect nonsmokers from secondhand smoke exposure. This is a proposal by Davidon Homes to develop approximately 29 acres (or 7%) of the 410-acre project site with 69 single family homes and seven attached secondary dwelling units (a.k.a. “casitas” or “in-law units”).
As shown on the project site plan on the project page, the proposed lots are shown in blue while the remaining 381 acres (shown in white) would be converted to permanent open space.

No. The name of the proposed project selected by the developer is The Magee Preserve. If approved, the project would set aside approximately 93% of the site as permanent open space. However, at this time the property is privately owned by the Magee family and has development rights based on General Plan and zoning regulations established long before the Town’s incorporation.

As shown on the site plan (on the project page), the property is located on the south side of Diablo Road and Blackhawk Road extending approximately two miles east from the intersection of Diablo Road/Green Valley Road/McCauley Road.
Most of the proposed homes (66 units) would be situated behind existing development on the south side Blackhawk Road, set back from the road. The remaining three homes would be located off of McCauley Road, near the Diablo Road intersection.

The existing “Magee property” is comprised of 10 separate parcels with a range of General Plan and zoning designations; most of the property is covered by the either the Agricultural or Rural Residential Land Use Designations. Table 3-2 (page 3-11) of the Revised Draft Environmental Impact Report (Revised DEIR) provides a summary by parcel.
It’s important to note that both the Danville General Plan and Town’s Zoning district for the Agricultural and Rural Residential Land Use Designations permit residential uses. Specifically, this property’s zoning of A-2; General Agricultural District permits “a detached single-family dwelling on each parcel and the accessory structures and uses normally auxiliary to it” by right. The zoning allows up to one home per five acres.

As a first step in the Town’s development review process, a lot study is undertaken to determine a property’s maximum allowable development potential. This study takes into account the property’s permitted density (example: up to one home per five acres) as well as the relevant development standards that apply (example: no development within 100 vertical feet of a ridgeline or on slopes in excess of 30-percent, etc.). The conclusion of this study was that the Magee Ranch property had the right to request a maximum of 78 lots.
In 2010, SummerHill Homes submitted a development application for 85 homes. Through the environmental review process, the proposal was reduced to 78 homes in 2011 and subsequently to 70 homes by late 2012. In response to comments that surfaced through the Draft EIR prepared for the original project, the unit count was reduced further to 69 homes.

A city’s General Plan outlines the development rights of every parcel within its limits. In this case, the property’s General Plan land use designations and its corresponding zoning districts allows up to 78 lots. Denying a landowner the ability to request a development proposal consistent with the General Plan could constitute an unconstitutional taking of private property rights.

On November 7, 2000, the voters in Danville approved Measure S, which amended the Town’s General Plan. It requires that any change to lands designated in the General Plan as (1) Agricultural, (2) General Open Space, or (3) Parks and Recreation would be subject to a vote of the people or a 4/5 vote of the Town Council.
Properties designated as General Open Space or Parks and Recreation have no development potential, but properties designated as Agricultural do have some limited development potential.
Therefore, a property designated as Agricultural may be developed without triggering a Measure S vote – as long as the proposed development does not exceed the maximum density permitted by that land use designation. Any development proposal that exceeds the maximum permitted density would require a General Plan Amendment and be subject to a Measure S vote.
As a final note, many of the comments have referred to the property as “Agricultural Open Space,” which has led to a misunderstanding that the property has no development potential. “Agricultural” and “Open Space” are, in actuality, two separate General Plan land use designations.

No. The reason why is that the proposed project is requesting a change in the Zoning district; not a change to its General Plan land use designation. The proposed rezoning does not add development potential. Instead, it serves to transfer all development rights of the 410-acre site to just 29 acres and preserves the remaining 381 acres as permanent open space (Revised DEIR, page 1-1).

While the property owner could propose to subdivide the property with all homes spread across the entire 410 acres, it would be inconsistent with the Town’s General Plan. The Danville General Plan contains several “Special Concern Areas,” which are properties that warrant additional and specific direction related to its potential development. The Magee Ranch property is one of these Special Concern Areas and the General Plan’s direction for it states that:
“[P]roposals which transfer the allowable number of homes to the least sensitive and obtrusive parts of the site are encouraged.”
“[S]ubdivision of this Special Concern Area into five-acre ‘ranchette’ sites similar to those in the Tassajara Lane/Sherburne Hills area is strongly discouraged. Such development would require grading and road construction that could substantially diminish the visual qualities of the area. Transferring allowable densities to a limited number of areas within the ranch would enable the bulk of the site to be set aside as permanent open space.”
The only way to meet these planning objectives is to rezone the property to allow for the transfer of potential development of the 410-acre site to just 29 acres, preserving the remaining 381 acres as permanent open space.

The traffic analysis studied the project’s potential impact using a methodology that allows the Town to distinguish between current traffic conditions from the project’s contribution to an existing traffic baseline. Under law, a project is only required to mitigate its own impacts to the baseline rather than to fix all existing problems.
The analysis concluded that the project would increase the daily traffic volume along the Diablo Road corridor, west of Mt. Diablo Scenic, by 4-percent. The project would also be required to contribute its fair share of future road improvements.
As a contribution toward improving the travel corridor, the project applicant has agreed to improve the intersection of Diablo/Green Valley/McCauley intersection by extending the westbound right-turn and through lanes. This would increase the number of cars that can move through one traffic signal cycle and decrease the overall wait time, improving the operation of the intersection.
It is also worth noting that the methodology used in the traffic analysis has been upheld by the both the Contra Costa County Superior Court (2013) and the California Court of Appeal (2015). {Internal Note: these will be linked to documents}

Yes, the traffic study performed an analysis of bicycle safety using a nationally recognized method established by the Highway Capacity Manual (HCM 2010). The analysis concludes that a proposed development of 69 homes has a negligible impact on bicycle safety.
It is also worth noting that the proposed project would enable the Town to implement a long-term vision to build a paved multi-purpose path across this property as alternative to Diablo Road.

The hydrologic analysis that was prepared for the project and described in detail within Draft Environmental Impact Report (DEIR) concluded that the project would mitigate potential hydrologic impacts related to increases in peak flow rates by installing a detention basin that would maintain post-project peak flows at pre-project levels. As a result, the project would not result in an increase in peak flows in the creek.

The Draft EIR includes an analysis of the proposed development’s potential impact on public services, including police and fire. The analysis included interviews with both appropriate police and fire personnel. The analysis concludes that, while the development would incrementally increase demands on services, the development would not adversely impact response times, and would be considered less than significant.

Fire safety was fully studied as part of the Environmental Impact Report (EIR) prepared for the project. In consultation with the San Ramon Valley Fire Protection District, the report found that the project would not have a significant impact on fire safety in the area. As documented in the development’s Traffic Impact Analysis, the development would add an estimated 841 vehicle trips in a 24-hour period, with 804 originating from the 66 homes entering from the Blackhawk Road access and 37 vehicle trips originating from the 3 homes that that would access from the McCauley Road entry.
Specifically, of the 804 vehicle trips that would originate from the Blackhawk Road entry, approximately 93 vehicles (31 inbound and 62 outbound) would be generated during the 7:00 – 9:00 AM peak hour, 83 vehicles (50 inbound and 33 outbound) would be generated during the 2:00 – 4:00 PM (school) peak hour, and 68 vehicles (43 inbound and 25 outbound) would be generated during the 4:00 – 6:00 PM (commute) peak hour.
Of the 93 AM peak hour vehicles, 62 vehicles would exit the development on to Blackhawk Road with 40 vehicles traveling west on Diablo Road and 22 vehicles traveling east on Blackhawk Road.
Of the 83 school PM peak hour vehicles, 33 vehicles would exit the development on to Blackhawk Road with 20 vehicles traveling west on Diablo Road and 13 vehicles traveling east on Blackhawk Road.
Of the 68 commute PM peak hour vehicles, 25 vehicles would exit the development on to Blackhawk Road with 16 vehicles traveling west along Diablo Road and 9 vehicles traveling east along Blackhawk Road. There would be a total of 43 vehicles coming into the Blackhawk Road project entry with 28 vehicles traveling east on Diablo Road and 15 vehicles traveling west on Blackhawk Road.

However, recent increases from utility providers have outstripped those efforts. The Town has been able to combine the use of additional general fund expenditures and LLAD reserves to stabilize rates to continue to provide services. However, District reserves are almost exhausted and increased demands on the Town’s general fund make this approach unsustainable moving forward.
